Who these terms apply to

These terms and conditions apply to anyone who uses the Wagging Tongue website (waggingtongue.com) or engages Wagging Tongue for any service. By using our website or engaging our services, you agree to these terms.

Wagging Tongue is a freelance marketing studio based in St Kilda, Victoria, Australia.

Our services

Wagging Tongue provides freelance marketing services including but not limited to copywriting, email marketing, social media content, graphic design, logo refresh and web design. The specific services provided in each engagement are confirmed in writing via a proposal or service agreement before work begins.

Quotes and proposals

All quotes and proposals are valid for 30 days from the date of issue unless otherwise stated. A quote is not a guarantee of availability. Work does not begin until a proposal or service agreement has been accepted in writing and, where required, a deposit has been received.

Payment

Small jobs require full payment upfront before work begins. Larger projects require a 50% deposit upfront to confirm the start date, with the balance due within 30 days of the final invoice. A receipt is issued on payment received. A full invoice is issued on completion.

All prices are in Australian dollars. GST will be applied where applicable.

Revisions

Each project includes two rounds of revisions unless otherwise stated in the proposal. A revision round is one consolidated set of feedback, not a series of individual changes over time. Additional revision rounds can be arranged at an agreed rate.

Ownership of work

All work produced by Wagging Tongue remains the intellectual property of Wagging Tongue until the final invoice for that project is paid in full. Once paid, full ownership of the deliverables transfers to the client.

Wagging Tongue retains the right to include completed work in its portfolio and promotional materials unless the client requests otherwise in writing.

Cancellation

If a project is cancelled after work has begun, a kill fee applies for work completed to that point. The kill fee will be agreed in writing before any project commences. Any work completed and materials produced up to the point of cancellation remain the property of Wagging Tongue until the kill fee is paid.

Confidentiality

We treat all client information as confidential. We will not share your business details, project briefs, or any materials you provide with anyone outside the project without your written consent.

Limitation of liability

Wagging Tongue is not liable for any indirect, incidental, or consequential loss arising from the use of our services or website. Our total liability in connection with any project is limited to the fees paid for that specific project.

We do our best work for every client. We cannot guarantee specific business outcomes from our marketing services.

Website use

The content on waggingtongue.com is for general information only. We make no warranties about its accuracy or completeness. We reserve the right to update or remove content at any time without notice.

Governing law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria.

Changes to these terms

We may update these terms from time to time. The current version will always be available at waggingtongue.com/terms. Continued use of our website or services after any changes constitutes acceptance of the updated terms.
